Why Roberta Laundrie will most likely never face criminal charges

This is a topic that has been in the forefront of the internet sleuths that helped solve Gabby Petito’s disappearance and homicide minds since the tragedy unfolded last year. With many speculating that Brian’s parents, Roberta and Christopher Laundrie, helped cover up the tragic death of ‘America’s daughter’, it seems unimaginable that charges will never be pressed against the pair.


When dissecting the days after Gabby’s disappearance was announced to the world, and with new information that has been released within recent days, it seems that no crime was in fact committed by the killer’s parents themselves.


Here is what we know:


A letter, sent by Roberta Laundrie to Brian Laundrie has been revealed. Titled ‘Burn after you read this’, the letter is said to be ‘odd’ and ‘extreme’, and contains some form of offer to help Brian Laundrie regarding Gabby Petito. This letter is undated, and currently in the possession of the Laundries.


Now, you may be wondering why no charges have been pressed when the FBI had hold of this seemingly compelling evidence against Roberta for months. Unfortunately, it is not a crime to offer to help cover up a crime. It only becomes a crime when help is given.


The letter is said to state, ‘I would bake a cake and put a saw in it if you end up in jail’.


Speaking about the letter in question, Bertalino alleged it was written before the cross-country road trip took place. He said:


I do know it’s a movie. And what she wrote on the cover to a letter to Brian written many months before the trip, had the title of a movie on it.’


As we already know, Brian Laundrie used £1000 from Gabby’s bank card after her death during his journey home in her van. This in itself shows that no financial help was given to Brian by his parents.


Brian was not a person of interest until after his own disappearance, this meaning he was free to come and go as he pleased. His parents had no legal obligation to disclose his departure from their home at that point.


In fact, Brian’s remains were found in the exact area his parents disclosed to the FBI from the day they reported their son as missing. It took many days to find his skeletal remains due to the area being underwater for the majority of their search.


There is currently an ongoing civil court case filed by Gabby’s parents, Joe Petito and Nichole Schmidt, against Roberta and Christopher Laundrie. They are suing the couple after alleging that Roberta and Chris deliberately withheld that their son had killed the blogger before she was reported missing. It is claimed that the Laundries ‘had deliberately put out a false statement when they knew she was not alive.’


The statement read:


“On behalf of the Laundrie family it is our hope that the search for Ms Petito is successful and that Ms Petito is reunited with her family,”


Petito’s parents are seeking damages for the “intentional infliction of emotional distress”.


Brian’s parents did not attend the hearing.
